Technical cookies are those strictly necessary in order to “carry out the transmission of a communication over an electronic communication network, or strictly necessary for the provider of an information society explicitly requested by the subscriber or user to provide the service” (Art. 122, paragraph 1, of the Privacy Code).

They ensure the normal browsing and use of the website and their installation does not require the prior consent of the users.

They are not used for further purposes and they are normally installed directly by the owner or by the manager of the website. They can be divided into:

-navigation or section cookies, which guarantee the normal navigation and use of the website (allowing, for example, to carry out a purchase or to access restricted areas of the website),

-analytic cookies, assimilated with the technical cookies, whenever these are used directly by the manager of the website, in order to store information, in aggregated form about the number of users and about how these visit the website, and

-function cookies, which allow the user to navigate, basing on a set of criteria selected (for example, language, selected products), with the purpose of improving the service supplied to the user. For the installation of such cookies, no consent of the users is needed beforehand.

Profiling cookies

Profiling cookies are aimed to create user’s profiles and are used for sending advertisement messages in agreement with the preferences showed by the user during the navigation in internet. As these devices can invade more into the private area of the users, the European and Italian law foresee that the user should be conveniently informed about their use, expressing his valid consent.

Art. 122 of the Privacy Code refers to the use of such cookies, foreseeing that the “storage of the information into the terminal device of a user or the access to information already stored are allowed only if the user has expressed his consent and after he has been informed about the simplified ways, referring to art. 13 of the Privacy Code, comma 3”.
